YOUTH SHOWJUMPING FOUNDATION MEMBERSHIP WAIVER, RELEASE OF LIABILITY & PHOTO / MEDIA RELEASE
ASSUMPTION OF RISK & EQUINE LIABILITY ACKNOWLEDGEMENT
I acknowledge that participation in activities, programs, meetings, events, services, or use of facilities offered, organized, sponsored, or sanctioned by the Youth Showjumping Foundation (YSJF) (the “Association”) involves inherent risks, including but not limited to personal injury, illness, death, property damage, or other loss. I specifically acknowledge the inherent risks associated with equine activities, including but not limited to: the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them; the unpredictability of an equine's reaction to such things as sounds, sudden movements, and unfamiliar objects, persons, or other animals; certain hazards such as surface and subsurface conditions; collisions with other equines or objects; and the potential of a participant or other persons to act in a negligent manner. I knowingly and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, even if arising from the ordinary negligence of the Association.
RELEASE AND WAIVER OF LIABILITY In consideration of being accepted as a member of the Association, I, on behalf of myself and my heirs, executors, administrators, representatives, and assigns, hereby fully and forever release, waive, discharge, and covenant not to sue the Youth Showjumping Foundation (YSJF), and its directors, officers, members, employees, volunteers, agents, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, costs, or liabilities of any kind, whether known or unknown, arising out of or related to my membership, presence, or participation in Association activities, whether caused by the ordinary negligence of the Released Parties or otherwise.
INDEMNIFICATION AND HOLD HARMLESS I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to my actions, omissions, or participation in Association activities.
MEDICAL TREATMENT I understand that the Association does not provide medical or health insurance coverage for members. I consent to receive medical treatment deemed necessary in the event of injury or illness during participation and agree to be financially responsible for any medical care received.
PHOTO, VIDEO & MEDIA RELEASE I grant the Youth Showjumping Foundation (YSJF) and the Released Parties the irrevocable right and permission to photograph, videotape, record, or otherwise capture my likeness, image, voice, or participation in Association activities (collectively, the “Media”). I understand and agree that the Media may be used for lawful purposes, including but not limited to marketing, promotional materials, websites, social media, publications, educational materials, and other Association communications, without compensation or further approval from me. I waive any right to inspect or approve the finished Media or any written or electronic copy used in connection with it and release the Released Parties from any and all claims arising out of the use of the Media, including but not limited to claims for invasion of privacy, defamation, or right of publicity. This authorization remains in effect indefinitely unless revoked in writing; however, any Media captured prior to revocation may continue to be used.
SEVERABILITY & GOVERNING LAW If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of California.
ACKNOWLEDGMENT AND AGREEMENT I acknowledge that I have read and fully understand this Waiver, Release of Liability, and Photo/Media Release. I understand that by checking the box or signing this Agreement, I am giving up substantial legal rights, including the right to sue. I agree to these terms freely and voluntarily.
FOR MINOR PARTICIPANTS (UNDER 18 YEARS OF AGE) If the participant is a minor, I represent that I am the parent or legal guardian of the minor participant. I have read and understand this Agreement, and I consent to the minor’s participation. I agree to release, indemnify, and hold harmless the Released Parties from any and all claims arising out of the minor’s participation, to the fullest extent permitted by law.
